By accessing or using Review Fruit ("Service," "Platform," "we," "us," or "our") at review-fruit.com, you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
Review Fruit provides automated Google review collection and management services for auto detailing businesses and other service-based companies. Our Service includes:
Automated review request delivery via SMS and email
AI-powered review response generation
Personalized review request images
Social media review posting
CRM integration capabilities
Review routing and management dashboard
3. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use this Service. By using Review Fruit, you represent and warrant that you meet these eligibility requirements.
4. Account Registration
4.1 Account Creation
You must provide accurate, current, and complete information during registration
You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activities that occur under your account
You must notify us immediately of any unauthorized access or security breach
4.2 Account Termination
We reserve the right to suspend or terminate your account at any time for:
Violation of these Terms
Fraudulent activity
Abuse of the Service
Non-payment of fees
5. Subscription Plans and Pricing
5.1 Plan Tiers
Review Fruit offers three subscription tiers:
Starter Plan: $99/month - 50 review requests per month
Growth Plan: $199/month - 100 review requests per month
Pro Plan: $279/month - 300 review requests per month
5.2 Free Trial
New customers receive a 10-day free trial
No credit card required to start trial (if applicable)
You may cancel anytime during the trial period without charge
Subscription automatically begins after trial unless canceled
5.3 Billing
Subscriptions are billed monthly in advance
All fees are in USD unless otherwise stated
Payment is processed through secure third-party payment processors
You authorize us to charge your payment method on file
5.4 Refund Policy
We offer a 30-day money-back guarantee for first-time subscribers
Refunds requested after 30 days are at our sole discretion
Refunds do not apply to subscription renewals
Processing time for refunds is 5-10 business days
5.5 Price Changes
We reserve the right to modify pricing with 30 days' notice
Price changes apply to renewal periods only
Existing subscribers maintain current pricing until next renewal
6. Service Usage and Limitations
6.1 Fair Use Policy
Review requests are limited to your plan's monthly allocation
Unused requests do not roll over to subsequent months
Excessive or abusive use may result in account suspension
Service is intended for legitimate business use only
6.2 Review Request Compliance
You agree to:
Only send review requests to actual customers
Comply with Google's review policies
Not incentivize, pay, or coerce customers for reviews
Not create fake or fraudulent reviews
Follow CAN-SPAM Act and TCPA regulations for communications
6.3 Prohibited Activities
You may not:
Use the Service for illegal purposes
Violate any applicable laws or regulations
Spam, harass, or abuse customers
Attempt to manipulate Google rankings artificially
Share your account credentials with unauthorized parties
Reverse engineer or copy our software
Remove or modify any proprietary notices
7. Intellectual Property
7.1 Ownership
Review Fruit retains all rights to the Platform, including software, designs, and trademarks
Our Service is protected by copyright, trademark, and other intellectual property laws
You receive a limited, non-exclusive license to use the Service
7.2 Your Content
You retain ownership of customer data and content you provide
You grant us a license to use your content to provide the Service
We may use aggregated, anonymized data for analytics and improvements
8. Privacy and Data Protection
8.1 Data Collection
We collect and process data as described in our Privacy Policy
You are responsible for obtaining customer consent for communications
We comply with applicable data protection laws (GDPR, CCPA, etc.)
8.2 Customer Data
You represent that you have the right to share customer contact information
We will not sell or share your customer data with third parties
Data is stored securely and encrypted
8.3 Data Retention
Active account data is retained for the duration of your subscription
After cancellation, data is retained for 90 days then deleted
You may request immediate data deletion upon account closure
9. Third-Party Services
9.1 Integrations
Our Service integrates with Google Business Profile, CRMs, and other platforms
You are responsible for maintaining valid accounts with integrated services
We are not responsible for third-party service interruptions or changes
9.2 Google Business Profile
You must have an active Google Business Profile to use our Service
You authorize us to access your Google Business Profile for review management
You are responsible for compliance with Google's Terms of Service
10. Service Availability and Support
10.1 Uptime
We strive for 99.9% uptime but do not guarantee uninterrupted service
Scheduled maintenance will be announced in advance when possible
We are not liable for service interruptions beyond our control
10.2 Customer Support
Support is available via email during business hours (Monday-Friday, 9am-5pm MST)
We aim to respond to inquiries within 24-48 hours
Priority support may be available for higher-tier plans
11. Cancellation and Termination
11.1 Your Right to Cancel
You may cancel your subscription at any time through your account dashboard
Cancellations take effect at the end of the current billing period
No partial refunds for mid-month cancellations (except within money-back guarantee period)
You retain access to the Service until the end of your paid period
11.2 Our Right to Terminate
We may suspend or terminate your account immediately for:
Breach of these Terms
Non-payment of fees
Fraudulent or illegal activity
Abuse of the Service or our staff
Violation of Google's policies that affects our platform
12. Disclaimers and Limitations of Liability
12.1 Service "As Is"
The Service is provided "as is" and "as available"
We make no warranties regarding service quality, reliability, or results
We do not guarantee specific review volumes or business outcomes
12.2 No Guarantee of Results
We cannot guarantee customers will leave reviews
Review volumes depend on multiple factors outside our control
Past performance does not guarantee future results
12.3 Limitation of Liability
To the maximum extent permitted by law:
We are not liable for indirect, incidental, or consequential damages
Our total liability is limited to the amount you paid in the last 12 months
We are not responsible for lost profits, data, or business opportunities
12.4 Indemnification
You agree to indemnify and hold Review Fruit harmless from any claims, damages, or expenses arising from:
Your violation of these Terms
Your violation of any third-party rights
Your misuse of the Service
Customer complaints related to your review practices
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law provisions.
13.2 Arbitration Agreement
Any disputes shall be resolved through binding arbitration in Salt Lake City, Utah, rather than in court, except you may assert claims in small claims court.
13.3 Class Action Waiver
You agree to resolve disputes individually and waive the right to participate in class actions or class arbitrations.
14. Changes to Terms
14.1 Modifications
We reserve the right to modify these Terms at any time
Changes will be effective upon posting to our website
Continued use of the Service constitutes acceptance of modified Terms
Material changes will be communicated via email
